2. Client Obligations

By engaging our services, you agree to:

  • Abide by all contractual obligations agreed upon with MN Real Estate Agents.

  • Notify us of any changes that may impact our ability to deliver services.

  • Treat our team and contractors with respect and professionalism.


3. Agent Obligations

We commit to:

  • Deliver our services professionally, ethically, and in line with applicable legislation.

  • Maintain confidentiality and protect your personal data as outlined in our Privacy Policy.

  • Act in your best interest when representing your property or interests.

  • Provide transparent communication and documentation throughout the engagement.


4. Fees and Payments

Fees for our services are disclosed upfront and agreed upon before the commencement of work. Depending on the service, fees may be:

  • A fixed fee

  • A commission-based fee (e.g. percentage of sale price or rent)

  • Ongoing management fees for property management services

Invoices must be paid in full by the due date stated. Late payments may incur administrative charges.


5. Listings and Property Advertising

By listing a property with us, you grant MN Real Estate Agents permission to:

  • Market and advertise the property via online and offline platforms.

  • Use photos, videos, and descriptions of the property for promotional purposes.

  • Conduct open inspections and private viewings in coordination with you.

You must ensure all representations about your property are truthful and accurate.


6. Tenancy and Property Management

For property management services, MN Real Estate Agents will:

  • Collect rent and disburse payments to you in a timely manner.

  • Conduct inspections and manage maintenance in accordance with lease agreements.

  • Handle communication with tenants, including issuing notices and lease renewals.

You agree to comply with landlord obligations under the Residential Tenancies Act relevant to your state.


7. Limitation of Liability

While we strive to deliver our services with diligence and care, MN Real Estate Agents is not liable for:

  • Losses or damages resulting from market fluctuations or property value changes.

  • Acts of third parties, including tenants, buyers, or service providers.

  • Delays or disruptions beyond our reasonable control.

You agree to indemnify MN Real Estate Agents against any claims, damages, or legal costs arising from your breach of these terms.


8. Privacy

Your privacy is important to us. All client information is handled in accordance with our Privacy Policy, which complies with the Australian Privacy Act 1988. We do not share or sell your personal information without your consent.


9. Termination of Services

Either party may terminate a service agreement with written notice, subject to any terms set out in individual contracts. Upon termination:

  • All outstanding fees must be settled.

  • Any shared materials, keys, or access must be returned or revoked.

  • Obligations under ongoing leases or sales agreements may continue until resolved.


10. Governing Law

These Terms of Service are governed by the laws of Australia and the applicable state or territory in which the property or service is located. Any disputes will be subject to the jurisdiction of the appropriate Australian courts.


11. Changes to These Terms

We may update these Terms from time to time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of the updated Terms.
